TERMS OF USE

These Terms of Use ("Terms") govern your access to and use of the HIO Studio website and the digital film-streaming services offered through it. By accessing this website, creating an account, or purchasing a film rental, you agree to these Terms.

1. About HIO Studio

HIO Studio is an independent film studio based in Kohima, Nagaland, India. The studio creates and distributes independent film and audiovisual content. For the purposes of these Terms, "HIO Studio", "we", "us" and "our" refer to the operator of HIO Studio.

2. Use of the Website

You may use this website for lawful purposes and in accordance with these Terms.

You must not:

  • use the website for an unlawful or fraudulent purpose;

  • attempt to gain unauthorized access to the website, accounts or systems;

  • interfere with the operation or security of the website;

  • copy, reproduce, distribute, publicly display, record, transmit, sell or otherwise exploit any film or copyrighted material available through the website;

  • circumvent technical measures used to protect our content;

  • share your account credentials with another person; or

  • use the website in a manner that could damage, disable, overburden or impair the website or its services.

 

3. User Accounts

A user account may be required to purchase and access a film. When creating an account, you agree to provide accurate information and keep your login credentials secure. Your account is intended for your personal use. You must not sell, transfer or share your account credentials with another person. You are responsible for activity carried out through your account and should notify HIO Studio if you believe your account has been accessed without authorization. 

HIO Studio may suspend or terminate an account where there is reasonable evidence of fraud, unauthorized access, misuse or a material violation of these Terms. HIO Studio may limit simultaneous access to the film from the same account or restrict access where an account is being used in a manner inconsistent with these Terms.

 

4. Film Rental

HIO Studio currently offers Can I Breathe for online rental.

Rental price: ₹199

The rental price displayed at the time of purchase will apply to that transaction. The rental provides the customer with a limited, personal right to stream the film online. It does not transfer ownership of the film or any intellectual property rights to the customer.

Your rental period is: 24 hours from the time of successful purchase.

The 24-hour rental period begins when the payment is successfully completed, regardless of when you first begin watching the film. After 24 hours, your access to the film will expire automatically.

The rental is for personal, individual use and does not permit simultaneous viewing by multiple people or devices using the same account.

 

5. Video Quality

Can I Breathe will be made available for streaming at up to 1080p resolution.

Actual playback quality may vary depending on your:

  • internet connection;

  • network conditions;

  • device;

  • browser;

  • display; and

  • other technical factors.

The film is delivered through a third-party video streaming service used by HIO Studio.

 

6. Payment

The rental fee must be paid through the payment methods made available on the website.

Your rental will become available after successful confirmation of payment.

Payment processing may be handled by a third-party payment service provider. HIO Studio does not directly collect or store complete card numbers, CVV numbers or other sensitive payment credentials.

7. Refunds and Technical Problems

Because the rental provides digital streaming access, refunds are generally not available once access to the film has been provided or the rental has begun, except where required by applicable law.

If you have paid for the film but are unable to access it because of a genuine technical problem with the HIO Studio service, please contact us at: hiostudiokohima@gmail.com

Please provide your transaction details and a description of the problem. HIO Studio will make reasonable efforts to investigate and resolve genuine technical problems.

Where appropriate, HIO Studio may restore access, extend the rental period, or provide another reasonable remedy for a verified technical problem affecting the purchased rental.

Nothing in these Terms is intended to remove or restrict any consumer rights that cannot legally be excluded or restricted.

 

8. Intellectual Property

All films, trailers, photographs, artwork, logos, graphics, text, audio, video and other materials available through the website are owned by HIO Studio, its licensors, or other respective rights holders, as applicable. Can I Breathe and all associated audiovisual materials remain protected by applicable intellectual property laws.

Your ₹199 rental gives you only a limited, personal and non-transferable right to stream the film during your 24-hour rental period.

It does not give you ownership of the film.

You must not:

  • download or record the film;

  • reproduce or redistribute the film;

  • upload the film to another website or platform;

  • share copies of the film;

  • publicly screen the film without authorization;

  • sell or sublicense access; or

  • attempt to circumvent technical protections used to secure the film.

 

9. Unauthorized Access and Use

If HIO Studio reasonably believes that an account has been used to obtain unauthorized access to the film, share access, reproduce or redistribute the film, circumvent security measures, or otherwise materially violate these Terms, HIO Studio may suspend or terminate the account and revoke access to the service.

This does not affect any rights or remedies available under applicable law.

 

10. Third-Party Services

The website may use third-party services for functions including:

  • website hosting and functionality;

  • payment processing;

  • video streaming and delivery;

  • analytics;

  • security; and

  • communications.

These services may have their own terms and privacy policies.

 

11. Availability of the Service

HIO Studio aims to provide reliable access to its website and streaming services but cannot guarantee uninterrupted or error-free availability.

Temporary interruptions may occur because of:

  • maintenance;

  • technical problems;

  • internet or network failures;

  • third-party service interruptions;

  • security measures; or

  • circumstances outside our reasonable control.

HIO Studio is not responsible for interruptions caused solely by the customer's internet connection, device, browser or equipment.

 

12. Changes to the Website or Services

HIO Studio may update, modify or discontinue website features or services where reasonably necessary. Any rental already purchased will remain subject to the terms displayed at the time of that purchase, subject to applicable law.

 

13. Changes to These Terms

These Terms may be updated from time to time to reflect changes to the website, services, legal requirements or business practices. Updated Terms will be posted on this website with the revised effective date. Changes will apply to future use of the website and future purchases. A rental already purchased will remain subject to the Terms applicable at the time of purchase, except where a change is required by applicable law.

 

14. Governing Law

These Terms shall be governed by the laws of India.

Any disputes shall be handled in accordance with applicable Indian law and the courts or other appropriate forums having jurisdiction, subject to applicable consumer-protection laws.
